A quick summary before the legal detail

Who this applies to
The Terms and Conditions apply to every customer and every job, including the engagement, audit and exit part in clauses 55 to 63. The Managed Service Bundle Agreement only applies if your business has a managed service agreement with Real Bytes.
Term and notice
Managed services run for an initial 3 months, then month to month with no lock-in. Either side can end the agreement with 60 days' written notice. Anything Real Bytes has arranged on a fixed vendor commitment, such as Microsoft annual pricing for 12 months, runs and is paid to the end of that commitment (clause 62.3 and Part 5 of the Managed Service Bundle Agreement).
Pricing
Prices are exclusive of GST. Recurring charges can rise each year by the greater of CPI or 5.9%, with at least 30 days' written notice.
Liability
Real Bytes' total liability is limited to the charges for the affected services in the six months before the event. Indirect losses are excluded.
Audits and reports
An audit, assessment or report by Real Bytes describes your business's systems at the time of the work. It is not ongoing monitoring unless a managed service agreement with Real Bytes says so.
What Real Bytes looks after
Real Bytes manages only what is in a managed service agreement. For ad hoc support or a project, Real Bytes does the job your business asks for. Buying licences, hardware or support from Real Bytes does not mean Real Bytes manages, maintains or secures them, or your systems, unless they are added to a managed service agreement.
Your cyber security risk
Your business is responsible for its own cyber security risk, including the security of its data and systems. Real Bytes is responsible for the services it has agreed to provide, but engaging Real Bytes does not move that risk to Real Bytes. As the Australian Signals Directorate puts it, a customer "can't outsource risk" (clause 63).
When an engagement ends
Your business, not Real Bytes, is responsible for securing its systems. That means removing Real Bytes software, accounts, admin and partner access, apps and integrations, and changing every password, key and credential Real Bytes used, by your new provider, your own staff or Real Bytes on request. Real Bytes will help if asked but does not guarantee everything is removed, and is not responsible for anything left or not changed after that date.
Your data on exit
Where Real Bytes holds your business's data, Real Bytes makes it available for 60 days after the agreement ends. After that it may be deleted.
Raising issues
Your business must raise any issue or claim with Real Bytes in writing within 1 month of it happening, and no later than 30 days after the engagement ends, including offboarding and removing Real Bytes access. For a project, audit or assessment, raise everything before the project closes, including the handover and Real Bytes access. These limits apply even if the issue is found later.
Governing law
Queensland, Australia. Real Bytes recommends independent legal advice if you have questions.
